The following declaration of interest was made at the meeting:

The Committee received a supplementary report that contained additional information in respect of the planning application.

Land north of Eastern Avenue, Southend-on-Sea (at Fossetts Farm and Southend United FC training ground)
Renewal of application 06/01300/FUL - Demolish nightclub and football training facilities, erect 22,000 seater football stadium including 114 bedroom hotel, conference floorspace, players hostel, food and drink concessions, bars and other ancillary facilities, erect 67 flats with basement parking, erect retail units (Class A1) totalling 16,400 sq metres of floorspace of which at least 20% shall be restricted to bulky/DIY goods, erect restaurant (Class A3) comprising 279 sq metres of floorspace, erect health club (Class D2) totalling 3205 sq metres of floorspace, lay out parking and cycle spaces and associated landscaping and form vehicular accesses onto Eastern Avenue and Fossetts Farm Link Road.
Resolved:

1. That the application be deferred to enable:

(a) all late representations to be considered;
(b) the Council's consultants to undertake a further assessment of the retail impacts of the scheme on the Town Centre; and
(c) further discussions with the applicant about the level of a Town Centre Contribution and the phasing of payment.

2. That officers be thanked for their hard work in preparing a detailed report for this special meeting in a short timescale.

604The Committee considered the report of the Corporate Director Enterprise, Tourism and the Environment concerning this application by Southend United Football Club to renew planning permission SOS/06/01300/FUL. This renewal application had originally been considered by the Committee at its special meeting held on 31st January 2012, where it resolved to grant planning permission subject to completion of a S.106 Agreement.

The S.106 Agreement has never been completed by the applicant, therefore, planning permission has not been issued. The applicant has now sought to vary some of the terms of the proposed S.106 Agreement, in particular to reduce the Town Centre contribution, introduce a phasing of the development and to extend the period for planning permission to 5 years as opposed to the normal period of 3 years.

A copy of a letter of representation by Gerald Eve dated 19th December 2012 on behalf of Orchard Street UK Special Situations Fund was tabled at the meeting. The Chairman afforded members of the Committee an opportunity to read the letter and consider its content.

Whilst the Committee was generally supportive of the club's ambitions, concerns were expressed about the adequacy of the retail impact assessment, the proposed reduction in the Town Centre Contribution and the short timescale for considering this application.
